BidGoat Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the BidGoat mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

BidGoat is a peer-to-peer marketplace for buying and selling jewelry and watches. The platform supports auctions, Buy It Now listings, and Must Sell flash sales. BidGoat facilitates transactions between buyers and sellers but is not a party to any transaction.

3. Eligibility

You must be at least 18 years old to use BidGoat. By creating an account, you represent that you meet this requirement and that all information you provide is accurate.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and all activity that occurs under your account. Notify us immediately at support@bidgoat.com if you suspect unauthorized access.

5. Buying and Selling

5.1 Sellers

• You must have the legal right to sell any item you list.
• Listings must be accurate, complete, and not misleading.
• You must ship sold items within 3 business days of payment confirmation.
• BidGoat charges a platform fee on each completed sale (see current fee schedule in the app).

5.2 Buyers

• All bids and Buy It Now purchases are binding commitments to pay.
• Payment must be completed promptly upon winning an auction or purchasing an item.
• You agree to pay the listed price plus any applicable shipping costs and taxes.

6. Prohibited Items and Conduct

You may not list, sell, or purchase counterfeit, stolen, or fraudulently obtained items, or items you do not have the right to sell. You may not manipulate bids, create fake accounts, engage in shill bidding, harass other users, circumvent BidGoat's payment system, or use the platform for fraudulent activity.

7. Payments

All payments are processed through Stripe. By making a purchase, you authorize BidGoat to charge your selected payment method. Buyer funds are held securely by Stripe and released to the seller after delivery confirmation. BidGoat does not store your full card details.

8. Fees

BidGoat charges sellers a platform fee on completed sales. Current fee rates are displayed in the app under Settings > Help > Revenue & Fees. Fees are subject to change with notice.

9. Disputes

If a transaction issue arises, buyers and sellers should first attempt to resolve it through in-app messaging. If unresolved, either party may open a formal dispute through the app. BidGoat will review evidence from both parties and make a final determination.

10. Returns and Refunds

All sales are final unless the item received is materially different from the listing description (wrong item, undisclosed damage, counterfeit). Eligible refund requests must be initiated within 3 days of delivery confirmation through the app.

11. Disclaimers

BidGoat is provided "as is" without warranties of any kind. We do not guarantee the accuracy of any listing, the authenticity of any item, or the conduct of any user. BidGoat is a marketplace facilitator, not a buyer or seller of goods.

12. Limitation of Liability

To the maximum extent permitted by law, BidGoat's total liability for any claim shall not exceed the fees paid by you to BidGoat in the 12 months preceding the claim.

13. Termination

BidGoat may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time through the app under Settings > Delete Account.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms.
